(hereinafter “Seller”) regarding the goods presented in the online shop.
1.2 A consumer is any natural person who enters into a legal transaction for purposes that predominantly cannot be attributed to their commercial or self-employed professional activity (§ 13 BGB).
1.3 An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their commercial or self-employed professional activity (§ 14 BGB).
1.4 Deviating, conflicting, or supplementary GTC of the Customer shall only apply if this has been expressly agreed in text form in advance.
2. Conclusion of Contract
2.1 The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.
2.2 By completing the electronic ordering process and clicking the “Buy voucher” button, the Customer submits a binding offer to conclude a purchase contract.
2.3 The Customer can change and review their entries at any time before submitting the order.
2.4 The contract is concluded by
- the transmission of an order confirmation by email
- the delivery of the voucher
- or the request for payment by the Seller.
2.5 The contract is concluded in the German language.
2.6 Orders may only be placed by persons with legal capacity.
3. Delivery and Shipping Conditions
3.1 Delivery is made to the address specified by the Customer.
3.2 Vouchers are sent
- by email or
- by post
to the Customer.
3.3 No shipping costs are incurred by the Customer for the dispatch of vouchers.
4. Prices and Payment Terms
4.1 All prices in the online shop are gross prices including statutory VAT.
4.2 The available payment methods are displayed in the online shop.
4.3 The purchase price is due immediately.
5. Retention of Title
5.1 With respect to consumers, the Seller retains ownership of the delivered goods until the purchase price has been paid in full.
5.2 With respect to entrepreneurs, the Seller retains ownership of the delivered goods until all claims arising from the business relationship have been settled in full.
6. Vouchers
6.1 Vouchers are valid from receipt of payment and can only be redeemed from that point onward.
6.2 Cash payment or refund of the voucher value is excluded.
6.3 Vouchers are transferable and not tied to a specific person.
6.4 To redeem, the voucher or voucher code must be presented at the time of booking or before using the service.
6.5 Vouchers are valid for three years from the date of issue, unless otherwise required by law.
6.6 Redemption is only possible after prior registration and upon presentation of the voucher.
7. Warranty
The statutory warranty rights apply.
For entrepreneurs, the warranty period is 12 months.
8. Liability
8.1 The Seller is fully liable in cases of
- intent or gross negligence
- injury to life, body, or health
- mandatory statutory liability (e.g., Product Liability Act)
8.2 In the case of negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for the contract.
8.3 Otherwise, liability is excluded.
9. Data Protection
9.1 Personal data is processed exclusively for the purpose of contract fulfillment.
Processing is carried out in accordance with Art. 6 para. 1 lit. b GDPR.

10. Final Provisions
10.1 Amendments and additions to the contract must be made in text form.
10.2 Place of performance and payment is St. Englmar.
10.3 In commercial transactions, the place of jurisdiction is Straubing-Bogen.
10.4 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
10.5 Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
