1 Scope
1.1 These General Terms and Conditions apply to contracts for the rental provision of hotel rooms for accommodation as well as all related services and deliveries provided to the customer by Hotel Angerhof – Franz Wagnermayr (hereinafter “Hotel”).
1.2 The term “hotel accommodation contract” includes in particular:
• Accommodation contract
• Guest accommodation contract
• Hotel contract
• Hotel room contract
• Day wellness contract
1.3 The subletting or re-letting of the provided rooms as well as their use for purposes other than accommodation require the prior consent of the Hotel in text form.
1.4 The registration and use of the rented rooms for commercial purposes of any kind is prohibited.
1.5 The customer’s general terms and conditions shall only apply if this has been expressly agreed in advance in text form.
2 Conclusion of Contract, Contracting Parties, Limitation Period
2.1 The presentation of rooms on the Hotel’s website does not constitute a legally binding offer but an invitation to book.
2.2 The contract is concluded upon acceptance of the booking by the Hotel. Bookings can be made in writing, by telephone, by email, via the website, or through booking platforms.
2.3 Contracting parties are the Hotel and the customer.
2.4 Bookings may only be made by persons with legal capacity.
2.5 If the booking is made by a third party, that party shall be jointly and severally liable with the customer.
2.6 Claims against the Hotel generally become time-barred within one year from the statutory commencement of the limitation period. Claims for damages arising from intentional or grossly negligent breach of duty remain unaffected.
2.7 The contract is concluded in German.
3 Services, Prices, and Payment
3.1 The Hotel is obligated to keep the rooms booked by the customer available and to provide the agreed services.
3.2 The customer is obligated to pay the agreed prices for room rental and additional services.
3.3 Prices include the statutory value-added tax applicable at the time of contract conclusion.
3.4 Local charges, in particular spa tax or tourism levies, are not included and must be paid by the guest.
3.5 Hotel invoices are due for payment in full at the latest upon check-out without deduction.
3.6 The Hotel is entitled to request a reasonable advance payment or security deposit upon conclusion of the contract or during the stay.
3.7 The customer may only offset claims against the Hotel with undisputed or legally established claims.
4 Withdrawal by the Customer (Cancellation)
4.1 Withdrawal by the customer must be in text form.
4.2 Free cancellation is possible:
• during travel periods A, B1, and B2 up to 14 days before arrival
• during travel period C up to 21 days before arrival
4.3 In the event of later cancellation, 100% of the agreed room price minus the meal portion will be charged.
4.4 In the case of late arrival, early departure, or no-show, the agreed room price minus the meal portion will also be charged.
4.5 Day wellness stays can be canceled free of charge up to 1 day before the appointment. In the case of short-notice cancellation or no-show, 70% of the package price will be charged.
4.6 The customer is entitled to prove that no damage or a lesser amount of damage was incurred by the Hotel.
5 Withdrawal by the Hotel
5.1 The Hotel is entitled to withdraw from the contract if agreed advance payments are not made despite a reminder.
5.2 Withdrawal is also possible if
• force majeure or other circumstances beyond the Hotel’s control make contract fulfillment impossible
• rooms were booked under false information
• the stay is unlawful
• hotel operations or safety are endangered
5.3 In the event of justified withdrawal, the customer has no claim to compensation.
6 Room Availability, Arrival, and Departure
6.1 The customer has no entitlement to the provision of specific rooms.
6.2 Booked rooms are available from 3:00 PM on the day of arrival.
6.3 Arrival after 8:00 PM must be communicated to the Hotel.
6.4 On the day of departure, rooms must be vacated by 11:00 AM at the latest.
6.5 In case of late departure, the Hotel may charge:
• up to 2:00 PM: 50% of the lodging price
• thereafter: 100% of the lodging price
6.6 Guests are required to present a valid ID upon arrival and complete the registration form.
7 Pets
7.1 Dogs are allowed upon request in certain room categories.
7.2 Dogs are not permitted in the wellness area, restaurants, or on upholstered furniture and beds.
7.3 Guests must bring their own dog blanket, food bowl, and sleeping place.
7.4 An additional fee per night may be charged for dogs.
7.5 The owner is liable for all damage caused by their animal.
8 Liability of the Hotel
8.1 Claims for damages against the Hotel are excluded except in cases of
• injury to life, body, or health
• intentional or grossly negligent breach of duty
• breach of essential contractual obligations
8.2 The Hotel is liable for items brought in according to statutory provisions (§§ 701 ff. BGB).
8.3 No safekeeping is provided for vehicles in hotel parking areas or the garage.
8.4 Smoking is prohibited in all enclosed areas of the Hotel. In the event of a violation, the guest is liable for all resulting damages and costs, particularly for the costs of a fire brigade deployment.
9 Allergies and Special Dietary Requirements
Allergies or intolerances must be communicated before arrival.
Due to kitchen processes, complete avoidance of cross-contamination cannot be guaranteed.
Liability for allergic reactions is therefore only possible within the scope of statutory provisions.
The guest bears responsibility for their individual health risk assessment.
10 Vouchers
10.1 Vouchers can be purchased at the Hotel or in the online shop.
10.2 Vouchers are valid from the time payment is received.
10.3 Cash payment of the voucher value is excluded.
10.4 Vouchers are transferable and not tied to a person.
10.5 Vouchers are valid for 3 years from the date of issue.
10.6 Redemption is subject to the Hotel’s availability.
11 Conferences, Seminars, and Events
11.1 Reservations for events require written confirmation by the Hotel.
11.2 The final number of participants must be communicated no later than 14 days before the start of the event.
11.3 A reduction of up to 10% is possible free of charge up to 3 days before the start of the event.
11.4 Cancellations are only possible in text form.
Cancellation conditions:
• up to 21 days before: free of charge
• 20–7 days before: 50%
• 6–3 days before: 70%
• from 2 days before or no-show: 100%
11.5 The organizer is liable for damages caused by participants.
12 Data Protection
Personal data is processed exclusively for contract execution.

13 Final Provisions
13.1 Amendments to the contract must be in text form.
13.2 Place of performance and payment is St. Englmar.
13.3 Place of jurisdiction in commercial transactions is Straubing-Bogen.
13.4 German law applies excluding the UN Convention on Contracts for the International Sale of Goods.
13.5 Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
